Liquor Restrictions

Mechanisms available to address harm caused due to the use of liquor are provided under sections 64 and 175(1a) of the Liquor Control Act 1988.

Section 175(1a) enables the Governor, on the recommendation of the Minister to declare an area of the state a restricted area that prohibits the bringing in, possession and consumption of liquor in the declared area. In addition, penalties apply where a person commits an offence against the regulations and in this regard, the Police have the necessary powers to seize and dispose of opened or unopened containers of liquor that are brought into the restricted area illegally.

Section 64 of the Act allows for the Director of Liquor Licensing, where it is in the public interest, to impose conditions on licensees restricting the sale and supply of liquor from licensed premises. A condition may include a limitation, prohibition or an authorisation on any licence or permit and can relate to any aspect of business carried out under the licence, or any activity that takes place at the licensed premises.

The Liquor Control (Cheeditha Restricted Area) Regulations 2012 defines the Cheeditha Aboriginal Community to be the area of land being part of Lot 48 on Deposited Plan 248914 (Certificate of Title Volume 2191 Folio 716), that is within a 500 metre radius of the centre of the basketball court located at Latitude -20.751152 and Longitude 117.119838.

The Liquor Control (Jigalong Restricted Area) Regulations 2009 define the Jigalong Aboriginal Community to be the area of land the subject of-

  1. Reserve 41265 being the whole of the land in Certificates of Crown Land Title Volume LR3128 Folio 529 and Volume LR3128 Folio 530;
  2. Pastoral Lease 3114/1103 being the whole of the land in Certificate of Crown Land Title Volume LR3147 Folio 908;
  3. Crown Lease 154/1984 being the whole of the land in Certificate of Crown Land Title Volume LR3137 Folio 492.

The Liquor Control (Wangkatjungka Restricted Area) Regulations 2008 define the Wangkatjungka Aboriginal Community to be the area of land the subject of-

  1. Aboriginal Lands Trust Certificate Number 35196 (Lots 11 and 99); and
  2. Crown Reserve 26889 (Lots 6, 10 and 44).

The Liquor Control (Juwurlinji Restricted Area) Regulations 2014 defines the Juwurlinji Aboriginal Community to be the area of land being part of Lot 65 on Crown Lease 3114/958 that is within 5 km of the public phone box situated at latitude -16.87 and longitude 128.1858333 excluding the land that is part of Pastoral Lease 3114/1001.

The Liquor Control (Noonkanbah Restricted Area) Regulations 2009 define the Noonkanbah Aboriginal Community to be the area of land the subject of-

  1. Certificate of Title 2201/905 (Lots 4 and 50); and
  2. Crown Reserve 26355 (Lot 37); and
  3. any portion of Crown Lease 3114/576 (Lot 255) between the Fitzroy River and the southern border of Crown Reserve 23226.

The Liquor Control (Yakanarra Restricted Area) Regulations 2010 define the Yakanarra Aboriginal Community to be the area of land the subject of Crown Land Title–

  1. Lot 45 on Deposited Plan 91750 Volume LR3028 Folio 178; and
  2. Lot 350 on Deposited Plan 54642 Volume LR 3157 Folio 227.

The Liquor Control (Bayulu Restricted Area) Regulations 2010 define the Bayulu Aboriginal Community to be the area of land the subject of Crown Land Title–

  1. Lot 12 on Deposited Plan 182544 Volume LR 3123 Folio 495 Part Reserve 35197; and
  2. Lot 14 on Deposited Plan 18301 Volume LR 3123 Folio 496 Part Reserve 35197.

Current Restrictions

The Liquor Control (Koongie Park Restricted Area) Regulations 2010 define the Koongie Park Aboriginal Community to be the area of land the subject of Crown Land Title Lot 32 on Deposited Plan 191020 being the whole of land in the Certificate of Crown Land Title Volume LR3005 Folio 264.

Current Restrictions

The Liquor Control (Nicholson Block Restricted Area) Regulations 2010 define the Nicholson Block Aboriginal Community to be the area of land the subject of Crown Land Title Lot 68 on Deposited Plan 187445 being the whole of land in the Certificate of Crown Land Title Volume 3055 Folio 207.

Region Punmu
Current Restrictions

The Liquor Control (Punmu Restricted Area) Regulations 2010 define the Punmu Aboriginal Community to mean that part of Lot 13 on Deposited Plan 240373 (Record of Qualified Certificate of Crown Land Title Volume LR 3124 Folio 556) that is within the area bounded by the circumference of a circle with – the aerial at the centre; and a radius of 30 kilometres.

The aerial means the telecommunications installation located at Latitude 22 degrees 2 minutes 40.36 seconds South and Longitude 123 degrees 2 minutes 40.36 seconds South and Longitude 123 degrees 7 minutes 22.29 seconds East.

 

Region Irrungadji
Current Restrictions

The Liquor Control (Irrungadji Restricted Area) Regulations 2010 define the Irrungadji Aboriginal Community to be the area of land the subject of Lot 204 on Deposited Plan 183007 being the whole of the land in Record of Qualified Certificate of Crown Land Title Volume LR3051 Folio 972; and Lot 206 on Deposited Plan 183007 being the whole of the land in Record of Qualified Certificate of Crown Land Title Volume LR3013 Folio 425.

Region Kunawarritji
Current Restrictions

The Liquor Control (Kunawarritji Restricted Area) Regulations 2011 define the Kunawarritji Aboriginal Community to be the area of land up to a 50 kilometre radius measured from the telecommunications aerial located on Lot 333 on Deposited Plan 55302 at Latitude -22.329226 and Longitude 124.725562.

Tourist means a person who is -

  1. staying at a place that is at least 50 kilometres from his or her usual place of residence for a period of at least one night; and
  2. intending to stay away from his or her usual place of residence for a period of less than 12 months; and
  3. not in the course of travelling on a regular journey between his or her usual place of residence or his or her place of work or education; and
  4. travelling in the course of a holiday or for leisure, business, to visit friends or relatives or for any other reason; and
  5. not usually a resident in a community declared a restricted area under section 175(1a) of the Act;

Well 33 camping grounds means the Kunawarritji Camp at Well 33 on the Canning Stock Route located at Latitude -22.34189 and Longitude 124.77519

Region Looma
Current Restrictions

The Liquor Control (Looma Restricted Area) Regulations 2011 define the Looma Aboriginal Community as the area of land described as Lot 75 on Deposited Plan 213140 referred to in Certificate of Title Vol 1417 Folio 796 excluding —

  1. the portion south of Crown Reserve 23226; and
  2. the portion subject to Lease No. J509083L

The Liquor Control (Looma Restricted Area) Regulations 2011 prohibit a person from bringing into and possessing liquor in the restricted area with the exception of those transiting through, and not stopping, on a public road through the Looma Aboriginal community.

The regulations are due to expire on 27 May 2017.

Region Pandanus Park
Current Restrictions

The Liquor Control (Pandanus Park Restricted Area) Regulations 2011 define the Pandanus Park Aboriginal Community as the area of land described as Reserve 40277 being Lot 353 on Deposited Plan 35956 and being the whole of the land in Certificate of Crown Land Title Volume LR3130 Folio 726.

The Liquor Control (Pandanus Park Restricted Area) Regulations 2011 also authorise the police to seize and dispose of opened and unopened containers of liquor suspected of being brought into the restricted area.

The regulations are due to expire on 27 May 2017.

Region Warralong
Current Restrictions

The Liquor Control (Warralong Restricted Area) Regulations 2013 define the Warralong Aboriginal Community as:-

  1. the land lying within a circle of 20 kilometres radius measured from the centre of the Warralong basketball court located at 20.6484722° S, 119.590333° E; and
  2. the land lying within 15 metres of the centreline of that part of Goldsworthy Road which runs between Marble Bar Road and the circle described in paragraph (a).

*Please note exemptions apply to “exempt person”.

Exempt person means the driver of, or a passenger in, a transiting vehicle;

transiting vehicle means a vehicle that transits the Warralong Aboriginal Community on a public road without -

  1. stopping; or
  2. discharging any person or item.
Region Spinifex
Current Restrictions

The Liquor Control (Spinifex Restricted Area) Regulations 2014 define the Restricted Area as the Spinifex Native Title Determination Area, excluding the portion that is within Reserve 17614.

Tourist means a person who is -

  1. staying at a place that is at least 50 kilometres from his or her usual place of residence for a period of at least one night; and
  2. intending to stay away from his or her usual place of residence for a period of less than 12 months; and
  3. not in the course of travelling on a regular journey between his or her usual place of residence or his or her place of work or education; and
  4. travelling in the course of a holiday or for leisure, business, to visit friends or relatives or for any other reason; and
  5. not usually a resident in a community declared a restricted area under section 175(1a) of the Act;
